Spay and Neuter Laws

Arizona - 1990 - dogs and cats from all shelters and pounds must be spayed or neutered.



*Arkansas - 1981, 1999 - in counties with populations of more than 300,000, dogs and cats must be spayed or neutered in pounds entirely or partially supported by public funds. In those counties with a population less than 300,000, a pound may only release a cat or dog if the new owner signs a promise to have the animal spayed or neutered.



California - 1985 & 1998 - cats and dogs from pounds, humane shelters, and societies for the protection of animals must be spayed or neutered, or forfeit a deposit to the shelter. In counties with a population of 100,000 or more people, shelters are required to spay or neuter dogs and cats before adoption; counties with of population of less than 100,000 will be required to collect a deposit of no less than $40.



Connecticut - 1992 - dogs and cats adopted from municipal impound facilities are eligible for subsidized vaccination and sterilization from monies collected from unaltered dog licenses.



*Florida - 1980 - dogs and cats from all shelters both public and private must be spayed or neutered.



*Georgia - 1994 - all dogs and cats from shelters must be spayed or neutered.



*lllinois - 1984 - all dogs and cats from licensed facilities must be spayed or neutered.



*lowa - 1993 - all dogs and cats from pounds or shelters must be spayed or neutered.



*Kansas - 1988 - dogs and cats from pounds or shelters must be spayed or neutered.



*Louisiana - 1990 - dogs and cats from pounds or shelters must be spayed or neutered.



Massachusetts - 1987 - dogs and cats from shelters must be spayed or neutered, or forfeit a deposit to the shelter which may be used to follow-up to assure animals are spayed/neutered.



Michigan - 1997 - dogs, cats and ferrets from animal control shelters or animal protection shelters must be spayed or neutered.



*Missouri - 1992 - all dogs and cats adopted or released for adoption shall be spayed or neutered.



*Montana - 1997 - all dogs and cats adopted from a humane society, animal shelter, or pound must be spayed or neutered.



*Nevada - 1997 - all dogs and cats adopted from a humane society or animal shelter (releasing agency) must be spayed or neutered.



New Hampshire - 1993 - dogs and cats adopted from shelters are eligible for subsidized spaying or neutering from monies deposited in Animal Population Control Fund.



New Jersey - 1983, 1986 - dogs and cats from shelters are eligible for subsidized spaying or neutering from fees added to the cost of licensing or registering unneutered dogs. The New Jersey law is also funded through the sale of special license plates (1993).



New Mexico - 1993 - all dogs and cats from shelters must be spayed or neutered.



New York - (1990’s) - establishes an animal population control program which encourages residents of New York state to spay/neuter their dogs/cats by providing low-cost spaying/neutering services. Owners shall submit proof to a participating veterinarian that their dog/cat was adopted from a pound, shelter, duly incorporated spca, humane society of dog or cat protective association to be eligible for low-cost spay/neuter services.



*North Dakota - 1985 - by state law, cities have the authority to require mandatory spay/neuter of shelter animals if the shelter is funded by a specific tax levy authorized by state law.



*Oklahoma - 1986 - all dogs and cats from all public and private shelters must be spayed or neutered.



Pennsylvania - 1996 - no dog or cat may be adopted unless the animal has been spayed/neutered or unless the new owner signs an agreement to have the animal spayed/neutered and pays a deposit to ensure that the animal will be sterilized. This deposit is refunded upon presentation of written statement by a veterinarian that the animal has been spayed/neutered.



*Rhode Island - 1993 - all dogs and cats from shelters must be spayed or neutered.



South Carolina - 1998 - all dogs and cats from shelters must be spayed or neutered.



Tennessee - 2000 - all dogs and cats adopted from shelters must be spayed or neutered.



*Texas - 1991 - all animals adopted from public and private shelters must be spayed or neutered.



Utah - 1998 - Mandatory spay / neuter of animals adopted from shelters.



*Virginia - 1993, 1999 - all dogs and cats from shelters must be spayed or neutered.


  • * Denotes laws which make failure to spay/neuter a violation of the law. In other states, failure to spay/neuter merely results in forfeiture of a deposit.
