I just started reading your journey through hell. I still can NOT believe this ignorant VET!!!

And I am so sorry for your loss. There are lots of jerks out there who call themselves doctors but no nothing. And its very frustrating when you are limited to what can be done as time runs out as you try to treat whatever illness you guess is going on. ANd vets then cop an attitude or say something rude. I so far have had to switch vets several times due to them always pushing Hills Diet garbage and trying to tell me to feed my senior girl low protein when she has lost muscle mass in her legs. So I found another place but they are expensive but open to anything I ask. ANd for now--its working.

I so hope you get justice. And I cant believe how stupid people are now adays..
There is no justice that could have fixed her eyes and none that can bring her back.

We now have a wonderful vet at the VCA in Albuquerque. She is a cat advocate. On our visits we covered behavior. Mook's grieving and all other aspects of our cats health.  And while she gave me a bag of SD kitten she didn't force it on me like it was the only food. It was in a bag of goodies which included many good things. 

I have posted all of this because when a vet injures and or kills your pet you are in a vacuum because no one is going to come forward and help you. Unless you report and purse it the vet will never be held accountable for their mistakes. And even the best vets make them.  The good ones want to fix or mitigate what happened. Bad vets like the one I'm dealing with are morally defunct.  It was her job to reach out to us not for us to pursue her.

We have strong evidence. But even that may not prevail per the SVB or small claims. Nothing is ever 100% certain. But it will be a platform to start petitions to change the laws and move our companion pets from chattel to living creatures.  I can prove without question that Kitten was a true companion animal that lived in our home for 11.5 years and was always well cared for. The fact that a vet can blind and likely be the reason she's dead and her value is the cost of adopting a new cat should make every pet owner burning hot mad. Nor do we have to step into extremist views to find a reasonable solution.

If someone had poisoned my cat and caused blindness they would face criminal charges. Vets need to be protected so they will treat an animal and pet owners need some recourse when obvious malpractice occurs on a pet that the owner can prove was a companion animal. 

Beyond vet bills and replacement value.

Sounds like she has a bad lawyer if he (or she) has advised her to blame you for following her orders.  
 
I have no idea because we have no idea what she is telling her lawyer. Most of the response is nothing but typical rebuttal. I knew it was coming and I told myself to not let it get under my skin. I had a bad few hours. It stung pretty bad to have her blame us for the overdose and then claim we had done nothing to mitigate the damages.

Considering she failed to treat the conjunctivitis and over dosed her and that there is no treatment when the retina is damaged I don't think we could be held liable in way to take Kitten back there. We have the right to consult a specialist to see how much damage had been done and possible future issues that might arise from it. Unless she's hiding some state of the art tech in that clinic she would have had to refer us there anyway.

In any case, her defense won't wash.  It's just bluff and bluster.  And if she did hide some state of the art tech that would have benefited Kitten after the fact, then SHE  is the one who not only did nothing to mitigate the damages, she knowingly withheld a service which she knew would have helped.  There's no way she can come out of this looking good.

@Kittens Mom   I think you should use this anger to get in a good work out.  You'll feel better and you just never know when that extra muscle will come in handy. 

I know you want to wait to notify Bayer, but I think your claim will have more of an effect with the vet board if Bayer is after her as well.  And they can afford lawyers!

I have the physical Rx bottle with the dose she prescribed clearly marked on the bottle. For Kitten. And she is the veterinarian listed on the bottle. And yes I have the original printout from the visit listing 68 mg of enrofloxacin . I have the ER visit. The vet from the ASPCA pet poison control and an veterinary ophthalmologist who did an in depth exam of her eyes a week later. soonest we could get in and noted the retinal damage along with the need to make sure that no more than 5mg of enrofloxacin should not be used to avoid this kind of complication. And a follow up with that vet two weeks later where the progression of blindness had not progressed once the overdose was stopped.

This vet can go pound sand.  

These same documents. copies are in the hands of the state veterinary board.  All invoices from this vet are numbered.

Even knowing what we know I would not bother to pursue this in any court unless I felt we had overwhelming evidence of her misdeed.

Let her show up with something that states differently.

She has now accused us of causing Kitten's blindness and not doing anything to mitigate it.

We contacted Putney to confirm the pills in the bottle that were clearly not Baytril but a generic did come from them and were their 68 mg version of that drug.

I have no idea what she thinks her defense is to this.  I hope I don't puke listening to it.

Our cat had an obvious bad reaction to the overdose. She is responsible for the vet bills incurred. BTW I called her line at 2AM or so because I thought it might be a home line or switch to it. Her message advised if there was an ER to take our pet to a VCA. The phone number to the one she listed was further away and we literally stumbled on the one we're using while driving down that same street. They are a chain.  So you see from start to finish in this debacle we respected the VCPR. Followed the treatment plan and when there was an ER we responded in a more than reasonable time considering where we live and how far we had to drive.

Just making sure. I've heard of legal battles where one or the other attorney hired someone to steal the pertinent evidence, and I don't know what your vet's attorney is like. If she's spewing this, that's the only way I can see it sticking.
Laughing my butt off here. Considering where I live and the fact that you call 911 after the fact it would be pretty stupid to try that. but I made sure the physical evidence is safe. And she can spew all she likes. She's either incompetent. impaired or such a bad record keeper even she isn't aware of what she done. And if she thinks it's normal to give twice the safe dose on the caution part of the label and NOT get consent from the pet owners she's freaking delusional. We told the VCA the last week with Kitten no enrofloxacin without our consent. If that would have saved her somehow we would have but we wanted to be the ones that gave the ok that would have taken the rest of her vision. Of course antibiotics weren't the answer to her problem.

Oh and I've also made sure to safeguard those bottle because the number of pills proves we gave the medication as directed. Three missing. Sunday Monday Tuesday and Wed AM around 3 to the ER. Vet visit was on Saturday where Mengele likely overdosed her per injection also.  And believe me I know where I'd like to shove those pill bottles. Maybe she can read from that end.

So I called a lawyer this morning.  We will see how this goes. We have already paid the vet bills. If every penny has to go to make sure she's held accountable so be it. The reply to our complaint is so twisted I wonder what we're getting ourselves into with her. I expected some dickering about the amount of money. It never entered our minds she would twist things around and try and claim we were responsible for Kitten's vision loss.

And since she thinks it's normal to give a cat twice the safe dose of a medication known to cause retinal toxicity I'm going to forward all this stuff to the local DA as well. Knowingly giving an animal an overdose of any medication that can harm them should be considered animal abuse. I just feel weary today.

Honestly vets can't except normal pet owners to know vet terms and medication doses. Also if your talking to a lawyer maybe see if you can go after her for defamation of character because she basically acused you of harming you own pet even tho you followed her advice to a T. I'm deeply sorry for your loss and I'm glad I'm not in your shoes because I would not be so nice. my parents say I'm like a pit bull I dont let go lol

 I was involved in horse rescue most of my life. I simply have a different way of pit bulling around. And no I won't let this go. I'm just having a really despondent moment. the glass on Kittens shelf is smeared with my fingerprints. We are so heartbroken over losing her like this.  And I agree. If she thinks she can overdose and cause an animal to suffer it's deliberate cruelty. I doubt making that accusation in a reply to a summons would be slander. I wonder how much of her input is there and how much is a lawyer puffing. There is also a claim that this case has already been tried and cannot be heard again. That can only refer to the SVB which is not a legal entity or court. It is a peer review board with the power to sanction or revoke a license. Nor can she claim her attorney fees unless she can prove we made the whole thing up to pretty much harass her. They also are trying to take the stand that we are suing for Kitten who is not a legal entity and have the case thrown out. And because the NM form is so sparse on how much you can write we'll go down and amend that tomorrow and clarify it. Which I'm sure will cost us more. As always I hope she's reading this. Because her bully act is only making me grind my feet in harder and deeper. We're also asking for compensation for an object of special sentimental value. Yes I know it won't fly. And I don't care. That as much as anything is part of a petition to change the law regarding situations like this.  Professionals that we hire to care for our pets should be held to a higher standard.  Understand the amount asked for is nominal.

She's in hot water over this. If she loses it might reflect on the decision with the SVB. Which could have a direct effect on her license.  I have no idea how competent the lawyer is. I suspect it's probably being done as a friend favor. She hasn't got a case against us so if she is paying a lawyer it's her choice and out of her pocket. The laws are set up to protect someone bringing a case from being intimidated by threats of lawyer fees for the other side as they are making someone who brings a frivolous lawsuit pay.

Realistically she is a veterinarian and should be able to present her case for not being wrong all by herself. She is in fact her own expert witness. Sadly this expert witness gave us everything we need to win without needing to hire one of our own.

I tried the if it was me thinking. If it was me I would have checked my records and then called the client to try and make arraignments to keep it from going any further. Those vet bills would have been paid at the front desk when the client went to check out. I'm not saying that as a moral person. But one that would have seen that cat being cradled like  a baby between two 50 plus year old adults and known I was in hot water. I would have taken care of it before they heard of an entity called the SVB.

I can't stop crying today.

Well, absolutely.  That would have been the compassionate and responsible thing to do.  The professional thing to do, something this vet obviously is not.  I'm sorry you're having such a rough day.  I just tagged you in a different thread but don't want to make it worse for you.  One of the points about this situation with Dr. Mengele (I'm stealing from you) that makes me angriest is that she is hurting you all over again by having her lawyer try to blame you.  Of course, you know you're not at fault, but it still has to sting.  Grrrrr.

Hence the call to some lawyers. Hopefully one of them will be willing to take it on and not wan an arm and a let to do it.
