I can't tell, black cats never photograph well and long hair tends to obscure their bits. If it's a male he's neutered (or cryptorchid), though ;). A normal tom would have visible testicles. A visit to the vet should clear everything up, and if the kitty is new he/she probably needs some shots anyway.
