Is it possible to sue me if I don’t give her a kitten?

This is a strange situation, my roommates cat got mine pregnant. She had kittens, and I found homes for them. She is threatening to sue me if I don’t give her a kitten. I don’t find her a suitable owner. Is that possible? We had no agreement regarding her taking one, and she has not contributed to vet bills. Would like some insight if anyone knows. I’m stressing.

Without a contract signed and dated by both of you, I don't see how she has any legal standing. I doubt she'd be able to find a lawyer who'd be willing to take the case. If she decides to try to do it on her own she's likely to end up spending a lot of her money without the result she wants.

Be sure you have all the receipts for vet bills that you've paid. If you didn't keep the receipts the vet can give you copies.

How old are the kittens? How soon will they be going to their new homes?

She doesn't have any right to sue you. I'm sure if she even tried she'd soon realise the chances of her being able to sue you successfully are absolutely zero. It would be way to expensive for her to try and pursue this through a law court.

Make sure you get your cat spayed as soon as the kittens are weaned. She'll come into heat again and, if your room mate still has a tom cat in your house, she'll get pregnant right away. Not good for her health or for your finances.

If you live in the US people can, and frequently do, sue for pretty much anything. If she's dumb enough to actually try it the chances of that lawsuit being successful are pretty much zero though, so you're safe to tell her they're already spoken for.

Best thing to do would be get your Cat spayed ASAP so that doesn't happen again, and talk to your roommate about getting her Cat neutered so he doesn't start spraying everywhere.

Thank you for the insight. We have no contract or any sort of written agreement. Not even a text of me ever saying that. The kittens are very brand new, this is their fourth day on earth. They will be going to their loving homes in 8 weeks

I’m glad to hear this. Raven has her spay appointment scheduled and she is no longer my roommate, fortunately

me telling her they’re spoken for is what caused her to threaten to sue me. Sounds like it’s safe to say I can laugh that off though. She has her appointment to be spayed set, and I’m no longer her roommate :).

I am glad to know she is not your roommate anymore. What she is threatening you for is quite amusing yet strangely creepy.

i am glad the kitties have already been adopted.

First of all it’s silly that neither you or your room mate agreed to have the female cat done at the vets because literally it was obvious kittens would be the outcome, but no she has no right or can’t sue you whatsoever
It was actually really circumstantial, she was told Luna was a girl and we believed that many months. I also couldn’t get my cat spayed due to Covid restrictions and vets not allowing new patients and I was new to the area. I was able to find a Vet in my hometown that will take her as a new patient and she has an appointment to be spayed in 7 weeks :). I am happy to hear she has no right now though

I am so glad that you are out of that situation, and your girl has her appointment set! This was almost as odd as the man who threatened to sue my father for kitten support. Of course, this was back in the bad old days, when you just did not routinely spay or neuter animals. Glad those days are (mostly) gone.

Im not an expert on law suits and such but I agree with everyone else here. She legally cannot sue. There is no contract stating you would give her a kitten. And if you believe she is an unfit owner, and she tries to sue...

You can prove that she is unfit, and that she did not contribute once to the vet bills or to anything kitten related, and that you have no contract or any kind of solid agreement that you were gonna give her a kitten.

Which I am sure you can do that. The case would be dismissed and possibly she would get in big trouble for wasting the courts time and the lawyers time if she can even get a lawyer to take the case.

But I am glad to see you arent her roommate anymore, and you sweet baby is gonna get spayed. And I am very happy to see that all the kittens have been promised to loving homes!

Keep the kittens with their mom until they are 12 weeks old. They'll be better socialized and taught manners by mom by then and will be fully weaned.
